Thank you for visiting Y Hospitality. These Terms of Use are the agreement between you and us when you use yhospitality.com or our concept sites for Storico Fresco, Forza Storico, Yeppa Buckhead, Yeppa Beltline, and Y Bar (together, the "Sites"). Villa Yeppa, our property in Rimini, Italy, is governed by separate terms on its own website.

In these Terms, "Y Hospitality," "we," "us," and "our" refer to [LEGAL ENTITY NAME], doing business as Y Hospitality. "You" and "your" refer to anyone who accesses the Sites.

By using the Sites, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Sites.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a reservation, place an order, or purchase a gift card through the Sites. By doing so, you represent that you meet that requirement.

2. The Sites

We provide the Sites to introduce our restaurants and to make it easy to reserve a table, place an order, purchase a gift card, inquire about private events, and stay in touch. We may add, change, or remove features at any time.

3. Intellectual Property

The Sites and everything on them, including text, photographs, video, illustrations, logos, menus, recipes, and design elements, are owned by Y Hospitality or our licensors and are protected by copyright, trademark, and other intellectual property laws.

The names "Y Hospitality," "Storico Fresco," "Forza Storico," "Yeppa," "Yeppa Buckhead," "Yeppa Beltline," "Villa Yeppa," and "Y Bar," along with our logos, wordmarks, and trade dress, are trademarks of Y Hospitality or its affiliates. You may not use them without our prior written permission.

You may view and share content from the Sites for personal, non-commercial purposes, with attribution. Any other use, including reproduction, modification, redistribution, or scraping, requires our written consent.

4. Reservations

Reservations made through the Sites are facilitated by OpenTable. When you book through us, you are also entering into OpenTable's terms of service and privacy policy. We pass your booking details to the restaurant you selected and rely on you to provide accurate information.

We may modify or cancel a reservation in the event of unforeseen circumstances, including private buyouts, weather, or operational issues. We will use reasonable efforts to notify you and accommodate you when this happens.

5. Gift Cards

Gift cards purchased through the Sites are issued and processed through Toast. Unless required otherwise by Georgia law, gift cards are non-refundable and may be redeemed only at the location for which they were purchased. Gift cards have no cash value except where required by law, cannot be replaced if lost or stolen, and cannot be used to purchase other gift cards. Additional terms may appear at checkout, and those terms apply along with these.

6. Online Ordering

Pickup and to-go ordering at Forza Storico and Storico Fresco is powered by Toast. When you order through us, you are also entering into Toast's terms of service. Order availability, menu selections, prices, and pickup windows are subject to change. We reserve the right to refuse or cancel an order, including for suspected fraud, item availability, or pricing errors.

7. Newsletter and Communications

If you sign up for our newsletter, you are agreeing to receive periodic emails from us. The signup form includes the following consent: "I accept the Privacy Policy and Terms of Use." You can unsubscribe at any time using the link in any email. We use Mailchimp to deliver our newsletter, and the privacy practices in our Privacy Policy apply.

8. Acceptable Use

When using the Sites, you agree not to:

• Use the Sites for any unlawful purpose or in violation of these Terms
• Interfere with or disrupt the Sites, servers, or networks
• Attempt to gain unauthorized access to any part of the Sites
• Use automated tools to scrape, harvest, or copy content without permission
• Submit false, misleading, or harassing information through any form
• Impersonate another person or entity
• Reverse engineer, decompile, or otherwise attempt to extract source code or proprietary information

We may suspend or terminate your access to the Sites at any time and without notice if we believe you have violated these Terms.

9. Disclaimers

The Sites are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Sites will be uninterrupted, error-free, or secure.

Menu items, prices, hours, photographs, and descriptions are provided for general information and may change without notice. Please contact the restaurant directly for the most current information, and let us know about any allergy or dietary need so we can do our best to accommodate you.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Y Hospitality, its affiliates, or its or their officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Sites, including loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.

In no event will our total aggregate liability for any claim arising out of or relating to these Terms or the Sites exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Y Hospitality and its affiliates and its and their officers, directors, employees, and agents from any claim, demand, or damage, including reasonable attorneys' fees, arising out of your use of the Sites, your violation of these Terms, or your violation of any rights of another.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. The exclusive venue for any action arising from or relating to these Terms is the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.

13. Dispute Resolution

We hope to resolve any concern informally. Before filing a formal claim, please contact us at the address in Section 16, describe the issue, and give us a reasonable opportunity to address it.

14. Modifications

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. Material changes will be communicated through the Sites or, where appropriate, by email. Your continued use of the Sites after an update means you accept the revised Terms.

15. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with the Privacy Policy and any other terms posted on the Sites, are the entire agreement between you and us about your use of the Sites. You may not assign these Terms without our consent. We may assign them to an affiliate or successor.
